TERMS OF SERVICE

1. SERVICE DESCRIPTION

AeroScope is a real-time flight tracking and airspace surveillance platform that processes publicly broadcast ADS-B (Automatic Dependent Surveillance-Broadcast) data. The platform provides aircraft tracking, threat scoring, pattern analysis, drone detection, and airspace complexity analysis through a web-based dashboard and API.

The service aggregates data from third-party community ADS-B receiver networks and processes it through proprietary analysis algorithms. AeroScope does not operate its own ADS-B receiver network and depends on community data sources for coverage.

2. ACCEPTABLE USE

AeroScope is intended for the following lawful purposes:

• Personal use: Aviation enthusiasts tracking aircraft activity in their area
• Academic research: Researchers studying flight patterns, airspace utilization, and aviation technology
• Security monitoring: Authorized security professionals monitoring airspace around facilities
• Journalism: Journalists investigating aviation-related stories using publicly available data
• Education: Students and educators learning about aviation, ADS-B technology, and airspace management

You agree NOT to use AeroScope for:

• Any unlawful purpose or in violation of any applicable laws or regulations
• Stalking, harassment, or tracking individuals
• Interfering with aviation operations or air traffic control
• Attempting to circumvent or exploit the platform's security mechanisms
• Automated scraping at rates exceeding the published API rate limits
• Reselling AeroScope data as a commercial data product without authorization
• Any activity that could endanger aviation safety

3. DATA ACCURACY DISCLAIMER

ADS-B data processed by AeroScope is provided on an "as-is" basis. ADS-B data is not guaranteed to be accurate, complete, or current. Specific limitations include:

• Aircraft positions may be inaccurate due to GPS errors, multipath interference, or transmission issues
• Not all aircraft transmit ADS-B. Coverage gaps exist, especially in remote areas
• Aircraft may appear or disappear as they enter and leave receiver coverage
• Threat scores, pattern classifications, and drone detections are algorithmic assessments, not definitive determinations
• Data from community receiver networks may have varying quality and availability
• Historical data is retained for only 7 days

AeroScope data must not be used for navigation, air traffic control, safety-of-flight decisions, or any purpose where inaccurate data could endanger life or property.

4. INTELLECTUAL PROPERTY

The AeroScope platform, including its user interface, analysis algorithms, processing pipeline, and documentation, is the intellectual property of AeroScope. ADS-B data itself is publicly broadcast and is not owned by AeroScope. Analysis results generated by AeroScope's algorithms (threat scores, pattern classifications, etc.) may be used by authenticated users for the acceptable use cases listed above.

5. NO WARRANTY

THE AEROSCOPE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEROSCOPE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL AEROSCOPE'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO AEROSCOPE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

7. INDEMNIFICATION

You agree to indemnify and hold harmless AeroScope and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.

8. ACCOUNT TERMINATION

We reserve the right to suspend or terminate access to the platform at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these terms, abusive use of the API, or behavior that threatens platform stability or security.

9. CHANGES TO TERMS

We may modify these terms at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of the platform after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
